Australia: Cracks Down on Social Media Age Limits Fines Set to Double

The Australian Government is turning up the heat on tech giants. In a new announcement, officials revealed plans to dramatically boost the policing powers of the eSafety Commissioner and double the financial penalties for social media platforms that fail to keep kids under 16 off their apps.

What’s changing?

Essentially, the government is giving the tech regulator a much bigger magnifying glass and a heavier hammer. Under the proposed legislation, the eSafety Commissioner will be able to:

  • Demand Receipts: Force social media companies to hand over concrete evidence showing exactly what they are doing to block users under 16.

  • Check with Third Parties: Look under the hood by demanding data from app stores and age-verification providers to prove whether the platforms are telling the truth about their compliance.

  • Enforce Bigger Consequences: Deploy a tougher suite of investigative tools to chase down platforms that break the rules.

The Cost of Breaking the Law

If tech companies don't cooperate, it is going to cost them massively. The government is planning to double the maximum penalties:

  • The fine for systematically failing to enforce the under-16 age limit will skyrocket from AUD 49.5 million to a staggering AUD 99 million (around $68 million USD).

  • Fines will also double for any platform that ignores or fails to comply with the Commissioner’s official information.
